Welcome to Excella (“Platform”, “we”, “us”, “our”), a digital property listing marketplace accessible via www.excella.co.ke.

By accessing or using the Platform, you agree to be bound by these Terms of Service (“Terms”). If you do not agree, do not use the Platform.

2. NATURE OF SERVICE

Excella is a listing and lead-generation platform that connects property owners, agents, developers, buyers, and tenants.

We:

  • Host and display property listings
  • Facilitate communication between users

We do not:

  • Own, sell, rent, or manage properties
  • Act as an agent, broker, or fiduciary in transactions
  • Guarantee the accuracy of listings or the outcome of transactions
  • All property dealings occur outside the Platform and are solely between users.

3. USER ELIGIBILITY

You must:

  • Be at least 18 years old
  • Provide accurate and complete information
  • Use the Platform in compliance with applicable laws of Kenya
  • We reserve the right to suspend or terminate accounts that violate these Terms.

4. USER ACCOUNTS

Users may register as:

  • Agents / Agencies
  • Property Owners / Landlords
  • Developers
  • Buyers / Tenants

You are responsible for:

  • Maintaining account confidentiality
  • All activities under your account
  • Excella is not liable for unauthorized account use.

5. LISTINGS & CONTENT

5.1 Listing Responsibility

Users who upload listings must ensure:

  • Accurate property details
  • Genuine images and descriptions
  • Correct pricing and availability

5.2 Prohibited Listings

You may not post:

  • Fake, misleading, or duplicate listings
  • Properties you are not authorized to market
  • Content that is unlawful, offensive, or fraudulent

5.3 Moderation Rights

Excella reserves the right to:

  • Review, edit, or remove listings
  • Suspend accounts associated with low-quality or fraudulent content

6. LEADS & COMMUNICATION

Excella may facilitate inquiries via forms, calls, or messaging integrations.

We do not guarantee:

  • Lead quality
  • Conversion or transaction success
  • Users are solely responsible for follow-up, negotiations, and agreements.

7. FEES & PAYMENTS

Excella may offer:

  • Paid listing features (e.g., featured listings)
  • Subscription plans
  • Lead-based pricing

All fees:

  • Are non-refundable unless stated otherwise
  • May change at our discretion with notice
  • Failure to pay may result in service suspension.

8. INTELLECTUAL PROPERTY

All Platform content (excluding user-generated listings), including:

  • Branding
  • Design
  • Software
  • is owned by Excella and protected under applicable intellectual property laws.
  • Users grant Excella a non-exclusive, worldwide license to display and distribute uploaded listings.

9. PRIVACY

Your use of the Platform is also governed by our Privacy Policy, which outlines how we collect and process personal data in accordance with applicable laws, including the Kenya Data Protection Act.

10. DISCLAIMERS

Excella provides the Platform “as is” without warranties of any kind.

We do not guarantee:

  • Accuracy of listings
  • Legitimacy of users
  • Availability of properties
  • Suitability for user needs
  • Users are advised to conduct independent due diligence before entering into any transaction.

11. LIMITATION OF LIABILITY

To the fullest extent permitted by law, Excella shall not be liable for:

  • Any direct or indirect losses arising from use of the Platform
  • Fraudulent listings or misrepresentation by users
  • Failed transactions or disputes between users
  • Your use of the Platform is at your own risk.

12. INDEMNIFICATION

You agree to indemnify and hold Excella harmless from any claims, damages, or liabilities arising from:

  • Your use of the Platform
  • Your listings or content
  • Your violation of these Terms

13. TERMINATION

We reserve the right to:

  • Suspend or terminate accounts
  • Remove content
  • Restrict access
  • at our sole discretion, without prior notice, for violations of these Terms.

14. GOVERNING LAW

These Terms shall be governed by and interpreted in accordance with the laws of Kenya.

Any disputes shall be subject to the jurisdiction of Kenyan courts.

15. CHANGES TO TERMS

Excella may update these Terms at any time. Continued use of the Platform constitutes acceptance of updated Terms.
